FMC — The Incubator
Terms of Service.
These terms are an agreement between you and Jeff Reynolds Productions LLC, an Arizona limited liability company doing business as FMC — The Incubator (“we”, “us”). They govern your use of this website and the member account and room-booking tools on it. By creating an account, signing in, or booking a room through this site you agree to them. If you don’t agree, don’t use the site.
Your account
- You must be at least 13 to create an account. If you are under 18, a parent or guardian must agree to these terms on your behalf and to your membership.
- Give accurate information and keep it current.
- Keep your password to yourself. You’re responsible for what happens under your account; tell us promptly if you think someone else has access to it.
- One account per person. Don’t share, sell or transfer it.
Membership
Membership of the FMC, including what it costs and how it is paid for, is arranged with us directly rather than through this website. This site does not process payments. Booking tools on the site are available to accounts we have activated as members, and we may deactivate an account’s booking access if the underlying membership ends.
Age restrictions on events
Membership itself has no age minimum beyond the account rule above. Individual events are a different matter: many events hosted by our members and partners are restricted to attendees who are 18+ or 21+, and some are restricted by law. The age policy for an event is set and enforced by whoever hosts it, and is stated on the listing. Check before you turn up, and bring ID.
Booking the rooms
- Rooms are booked by the hour and are first-come, first-served.
- A booking made here reserves the room; it is not a separate purchase.
- You’re responsible for how the room is used during your booking and for anyone you bring.
- We may move, shorten or cancel a booking when we have to — maintenance, safety, a scheduling conflict, or a breach of these terms. We’ll tell you if we do.
Making an event public
When you open a booking to the public it appears on our Events page. You are responsible for the accuracy of the event details and any ticket link you provide, for running the event lawfully, for any age restriction you set, and for anything you sell or collect in connection with it.
How ticketing works here. The FMC runs a box office in the sense that we facilitate it — we list your event, point people at it, and the front desk helps on the night. We are not the seller. Tickets are sold by the member or partner hosting the event, through their own platform and their own account, and the money goes to them directly. We do not take payment for event tickets, hold ticket funds, or issue refunds for them; questions about a ticket, a refund or a cancelled event go to the host who sold it. Where we have agreed a revenue share with a host, that is a separate arrangement between us and them and does not make us a party to your ticket purchase. We may remove any listing from the Events page at our discretion.
Content you submit
You keep ownership of the event titles, descriptions, links and other material you submit. By submitting it you give us a non-exclusive, royalty-free licence to display it on this site and in related promotion of the FMC. Don’t submit anything you don’t have the right to submit, and don’t submit anything unlawful, misleading, hateful, or infringing.
Acceptable use
Don’t use this site for anything unlawful. Don’t attempt to access accounts, data or systems that aren’t yours; don’t probe, scrape, overload or interfere with the site or the booking system; don’t upload malicious code; and don’t make bookings you have no intention of using in order to deny them to other members.
Our content
The FMC name, logo, site design, text and images are ours or our licensors’, and are protected by copyright and trademark law. You may view and share pages normally; you may not copy, republish or build on them commercially without our written permission.
Third-party links
The site links out to services we don’t control — ticketing platforms, maps, social profiles. We’re not responsible for their content, their practices, or their terms. Read theirs before you use them.
Disclaimers
This website and its booking tools are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that the site will be uninterrupted, error-free or secure, that any defect will be corrected, or that scheduling information shown here is complete or accurate at any given moment. Nothing on this site is professional advice.
Limitation of liability
To the fullest extent permitted by law, neither Jeff Reynolds Productions LLC nor its members, managers, employees or contractors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or business interruption, arising out of or relating to your use of this website — whether the claim is in contract, tort, strict liability or otherwise, and even if we were told such damages were possible. Our total liability for all claims relating to this website will not exceed one hundred U.S. dollars ($100). Some jurisdictions don’t allow certain of these exclusions, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.
This section is about the website. It does not address your presence at, or use of, our physical premises, which is covered by the separate agreement you sign with us.
Indemnity
You agree to indemnify and hold harmless Jeff Reynolds Productions LLC and the people listed above from any claim, loss, liability or expense (including reasonable legal fees) arising out of your use of this website, any content you submit, any event you list, or your breach of these terms.
Suspension & termination
We may suspend or end your access to this site and its booking tools for breach of these terms, or where we reasonably believe it is necessary to protect the site, our members or the FMC. You can close your account at any time by asking us. Sections that by their nature should survive termination — content licence, disclaimers, limitation of liability, indemnity, governing law — survive it.
Changes
We may update these terms. We’ll revise the “last updated” date above and, for material changes, give reasonable notice before they take effect. Continuing to use the site after that means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
